1. Acceptance of the Terms of Use Agreement By creating a Security Search account, whether using a mobile device, mobile application or computer (collectively, the "Service"), you agree to these Terms of Service, our Privacy Policy, our Cookie Policy, the Security Tips and the Community Guidelines, each of which is incorporated by reference into this Agreement, and any terms disclosed by you and agreed to if you purchase any additional features, products, or services that we offer through the Service (collectively, this "Agreement") to be bound. If you do not accept and agree to all of the terms of this Agreement, please do not use the Service. We may make changes to this Agreement and the Service from time to time. We may do this for various reasons, e.g. B. to reflect changes in legislation or changing legal requirements, new features or changes in business practices. The most current version of this Agreement will be posted as part of the Service in Settings and on Security-Search.org, and you should periodically review the most current version. The latest version is always the version that is valid. If the changes involve significant changes that affect your rights or obligations, we will give you at least 30 days' prior notice of those changes in a reasonable manner (unless we are unable to do so under applicable law), e.g. B. by notices through the Service or by e-mail. If you continue to use the Service after the changes take effect, you agree to the revised agreement. 2. Eligibility You may not create an account or access or use the Service or the systems on which it resides unless all of the following are true: • You are at least 18 years old. • You can enter into a binding contract with Security-Search; • You are not one of those persons who are barred from using the Service under the laws of the United States or any other applicable jurisdiction (for example, you will not be included on the US Treasury Department's list of Specially Designated Nationals) conducted or subject to any other similar prohibition), • You will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations; and • You have never committed a felony or a criminal offense or a crime of similar magnitude, or committed a criminal offense involving violence, and you do not have any state, federal or local criminal record. 3. Your Account To use Security-Search you can log in in different ways, e.g. B. with your Facebook login (update 2023). If you choose to log in using your Facebook login, you authorize us to access and use certain Facebook account information, including but not limited to your public Facebook profile. For more information about the information we collect from you and how we use it, please see our Privacy Policy. You are responsible for maintaining the confidentiality of the credentials you use to log in to Security-Search and are solely responsible for any activity that occurs under those credentials. If you think someone has hacked into your account, please contact us immediately or change your login information. 4. Modification of Service and Termination. Security-Search is always striving to improve the service and provide you with additional functionalities that you find appealing and useful. This means that from time to time we will introduce new product features or enhancements, as well as remove some features. If these measures do not materially affect your rights or obligations, we may implement them without notifying you in advance. We may even suspend the service altogether, in which case we will notify you in advance, unless mitigating circumstances, such as security concerns, prevent us from doing so. You may terminate your account at any time for any reason by following the instructions under "Settings" on the Service. However, if you use a third-party payment account such as Apple's App Store/iTunes Store ("App Store") or the Google Play Store, you must manage your in-app purchases through that account to avoid additional billing . Security-Search may terminate your account at any time without notice if we believe you have breached this agreement. After such termination, you will not be entitled to a refund. If your account is terminated, this Agreement will terminate unless the following terms continue to apply to you and Security-Search. 4. Security Your interactions with other members. Although Security-Search strives to promote a respectful user experience through features such as "search matching," which only allows communication between members after both have shown interest in each other and both also agree via email, Security-Search is not responsible for the conduct of Members on or off the Service. You agree to exercise caution in all interactions with other Members, especially if you decide to communicate off-Service or to meet Members in person. In addition, you agree to read and follow Security-Search's security tips before using the Service. You agree not to disclose financially-related information (e.g., your credit card or bank account information) to, or send money to, any other member, by wire transfer or otherwise. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT SECURITY-SEARCH DOES NOT CHECK THE CRIMINAL PAST OF ITS MEMBERS OR OTHERWISE INQUIRE ABOUT THE PAST AND BACKGROUNDS OF ITS MEMBERS. TINDER MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT OR COMPATIBILITY OF MEMBERS. 5. Rights Granted to You by Security-Search Security-Search grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable and non-sublicensable license to access and use the Service. This License is for the sole purpose of enabling you to use and enjoy the benefits of the Service in the manner intended by Security-Search and permitted by this Agreement. This license and any right to access the Service are automatically revoked if you do any of the following: • Use the Service or any content contained in the Service for any commercial purpose without our written consent. • Copy, modify, derivative works of any copyrighted material, images, trademarks, trade names, service marks or other intellectual property, content or proprietary information accessible through the Service without Security-Search's prior written consent to create, use or reproduce in any way. • express or give the impression that any statements you make are endorsed by Security-Search. • use any robot, bot, spider, crawler, website search/research application, proxy or other manual or automatic device, method or process to access, retrieve the navigational structure or presentation of the Service or its content, to "data mine" them or to duplicate or circumvent them in any way. • Use the Service in any way that could disrupt, disrupt, or adversely affect the Service or the servers or networks connected to the Service. • Upload viruses or any other malicious code or otherwise compromise the security of the Service. • Forge headers or otherwise manipulate identifiers to disguise the origin of any information transmitted through the Service. • "Frame" or "mirror" any portion of the Service without the prior written permission of Security-Search. • Use any meta tags, code, or other device containing a reference to Security-Search or the Service (or a Security-Search trademark, trade name, service mark, logo, or slogan) to identify any person for any other purpose lead to other websites. • Modify, adapt, sublicense, translate, sell, reverse engineer, decrypt, decompile, or otherwise disassemble any portion of our Service, or cause others to do so. • Use or develop third party applications that interact with the Service or other Members' content or information without our written consent. • use, access or publish the Security-Search application programming interface without our written consent. • Investigate, query or scan the vulnerability of our Service or any system or network. • Facilitate or encourage activities that violate this Agreement. Security-Search may investigate and take any available legal action in response to illegal or unauthorized use of the Service, including terminating your account. Any software that we make available to you may automatically download and install upgrades, updates or other new features. You may be able to customize these automatic downloads through your device's settings. 6. Rights You Grant to Security-Search By creating an account, you grant Security-Search a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display information that you allow us to access from third parties such as Facebook , reproduce, adapt, edit, publish, modify and distribute. This includes information that you post, upload, display or otherwise make available on the Service (collectively, "Post") or transmit to other members (collectively, "Content"). Security-Search's license to Your Content is non-exclusive, except that Security-Search's license is exclusive with respect to modified works created through use of the Service. For example, Security-Search would have an exclusive license to screenshots of the service that included your content. In addition, you authorize Security-Search to act on your behalf with respect to infringing use of your content taken from the Service by other Members or third parties so that Security-Search can prevent your content from being used outside of the Service. This expressly includes the right, but not the obligation, to send communications on your behalf if your content is taken from the Service and used outside of the Service by a third party. Our license to Your Content is subject to your rights under applicable law (e.g. laws governing the protection of personal information to the extent Content contains Personal Information as governed by such laws) and is solely for the purpose of operating, developing, providing and providing the Service to improve and research and develop new services. You agree that any Content that you place on the Service, or that we place on the Service on your behalf, may be viewed by other members visiting or participating in the Service (e.g., persons who may be see Security Search content for other members). You agree that all information you submit after creating your account, including information submitted from your Facebook account, is accurate and truthful and that you have the right to post the Content on the Service and to grant Security-Search the license referred to above. You understand and agree that we may monitor and review any Content you post on any Service. We may remove, in whole or in part, any Content that, in our sole discretion, violates this Agreement or may damage the reputation of the Service. In exchange for Security-Search enabling you to use the Service, you agree that we, our affiliates, and our third-party partners may place advertising on the Service. By submitting any suggestions or feedback regarding our Service to Security-Search, you agree that Security-Search may use and share that feedback for any purpose without compensation to you. Please note that Security-Search may access, store and disclose your account information and content if required to do so by law, in the performance of its contract with you, or in the good faith belief that such access, storage or Disclosure meets a legitimate interest, such as: to comply with a legal process; enforce the contract; respond to claims that any Content infringes the rights of third parties; to respond to your requests at; or protect the rights, property, or personal safety of the company or of any other person. 7. Community Rules By using the Service, you agree not to:• Use the Service for any purpose that is illegal or prohibited by this Agreement. • Use the Service for harmful or nefarious purposes • Use the Service to harm Security-Search • Violate our Community Guidelines, which are updated from time to time. • Sending spam, soliciting money from or scamming other members. • Impersonate any person or entity or post images of another person without their permission. • Bullying, stalking, intimidating, attacking, harassing, mistreating, or defaming others. • Post content that violates or violates any person's rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract law. • Post content that contains hate speech, is threatening, sexually explicit, or pornographic. • Post content that incites violence or contains nudity or graphic or gratuitous violence. • post any content that promotes racism, bigotry, hatred or assault of any kind against any group or individual. • Soliciting passwords for any purpose or personal information from other members for any commercial or illegal purpose, or disseminating another person's personal information without that person's consent. • use another member's account, share an account with another member, or maintain more than one account. • create another account where we have already terminated your account, unless you have our permission. Security-Search reserves the right to review and/or terminate your account without a refund for any purchases or subscriptions if you have violated this Agreement, abused the Service, or behaved in a way that Security-Search considered inappropriate or unlawful, including any actions or communications occurring on or off the Service. In addition, in certain cases, we may terminate your account for violations of the applicable Terms, which, in addition to Security-Search, also include services such as G.E.T-Tools and Mysa Finance. If you violate these rules or our Community Guidelines, your permission to use the Service will be automatically revoked. 8. Content from Other Members Although Security-Search reserves the right to review and remove any Content that violates this Agreement, such Content is the sole responsibility of the Member posting it and Security-Search cannot guarantee that all Content complies with this Agreement To be in harmony. If you notice any content on the Service that violates this Agreement, please report it within the Service. 9. Purchases General. From time to time, Security-Search may offer products or services for purchase ("In-App Purchases") through the App Store, Google Play Store, carrier billing, Security-Search Direct Checkout or other payment platforms authorized by Security-Search. If you choose to make an in-app purchase, you will be asked to confirm your purchase with the relevant payment provider and your payment method (your card or third-party account such as Google Play Store or App Store) (your "Payment Method") will be applied to the in-app purchase at the prices shown for the services you select and any VAT or similar taxes that may be levied on your payments, and you authorize Security-Search or the third party, if applicable to charge the appropriate fee. Automatic Renewal; Automatic card payment If you purchase an auto-recurring regular subscription through an in-app purchase, your payment method will be charged for the subscription on an ongoing basis until you cancel. After your initial subscription period, and again after each subsequent subscription period, your subscription will automatically continue for a corresponding period at the price you agreed to when you subscribed. Your card payment information is stored in accordance with the contract and then used for automatic card payment. Objections to a payment already made must be directed to the relevant third-party account such as the App Store if billed by Security-Search. You can also object by contacting your bank or payment processor, who can provide you with more information about your rights and applicable time limits. You can unconditionally revoke your consent to automatic card payments at any time in Security-Search's settings or in the relevant third-party account. However, we would like to point out that you are still obliged to pay outstanding amounts. If you wish to change or end your subscription, you must log into your account with the third party (or, if applicable, go to Security-Search's settings) and follow the instructions to end or cancel your subscription, even if you have your account with us or deleted the Security Search application from your device. Deleting your Security-Search account or deleting the Security-Search app from your device will not terminate or terminate your subscription; Security-Search will retain any funds charged to your payment method until you terminate or cancel your subscription through your Security-Search or third party account, as applicable. If you terminate or cancel your subscription, you can use your subscription until the end of the term of the current subscription period and your subscription will not renew when the period expires. Other terms that apply when paying directly to Security-Search using your payment method. When making a direct payment to Security-Search, Security-Search may correct any billing errors or mistakes even if it has already requested or received payment. If you issue a chargeback or otherwise reverse a payment through your payment method, Security-Search may, in its sole discretion, terminate your user account immediately. You can edit your payment method details by going to Security-Search and going to Settings. If a payment was not successful, e.g. B. by invalidity, insufficient funds or for any other reason, and you do not edit your payment method information or end or cancel your subscription, you remain responsible for unpaid amounts and authorize us to continue using the payment method you can edit the to charge fees. This may result in a change in your billing information. In addition, you authorize us to obtain updated or new expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The payment terms are based on your payment method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen payment method. Refunds. Generally, all fees for purchases are non-refundable and there are no refunds or credits for partially used periods. pricing. Security-Search is a global company and our pricing depends on a number of factors. We often offer special rates that vary by region, subscription, etc. Furthermore, we regularly test new features and payment methods. 10. Copyright Infringement Security-Search will terminate, delete, and permanently suspend the accounts of repeat infringers. 11. Disclaimers SECURITY-SEARCH PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" AND TO THE EXTENT PERMITTED BY APPLICABLE LAW AND MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SERVICE (INCLUDING ALL CONTENT), INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SECURITY-SEARCH DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICE WILL BE ACCURATE. SECURITY-SEARCH ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU, OTHER MEMBERS, OR THIRD PARTIES POST, SEND OR RECEIVE THROUGH THE SERVICE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK. 12. Third Party Services The Service may contain advertisements and promotions offered by third parties, as well as links to other websites or Internet resources. Security-Search is not responsible for the availability (or lack of availability) of such external websites or Internet resources. If you choose to interact with third parties through our Service, their relationship with you will be governed by the terms of those third parties. Security-Search is not responsible or liable for the terms or actions of such third parties. 13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECURITY-SEARCH, ITS AFFILIATES, EMPLOYEES, LICENSORS OR SERVICE PROVIDERS HAVE ANY LIABILITY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE, OR AWARDED DAMAGES, INCLUDING, BUT NOT LIMITED TO, WHETHER DIRECT OR INDIRECT, OR LOSS OF DATA, GOODWILL, LOSS OF USE OR OTHER INTANGIBLE LOSS RESULTING FROM: YOUR USE OF OR ACCESS TO THE SERVICES OR YOUR INABILITY TO USE THE SERVICE, THE CONDUCT OR CONTENT OF OTHER MEMBERS OR THIRD PARTIES IN CONNECTION WITH THE USE OF THE SERVICE; OR UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF SECURITY-SEARCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU. 14. Indemnification by You To the fullest extent permitted by applicable law, you agree to indemnify and defend against Security-Search, its affiliates and their respective officers, directors, agents and employees with respect to any and all suits, demands, demands, damages, losses, costs, liabilities, expenses and attorneys' fees indemnify, defend and hold harmless arising out of or in any way related to your access to or use of the Service, Your Content, or your breach of this Agreement. 15. If any provision of this Agreement is deemed invalid, the remainder of this Agreement will remain in full force and effect. Company's failure to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. You agree that your Security Search account is non-transferable and that all of your rights in your account and its contents end after your death. This Agreement does not create any agency, partnership, joint venture, fiduciary, or other special relationship or employment relationship, and you shall not make any representations or bind Security-Search in any way.
